Collision claims life of a pedestrian

Many intersections in California have crosswalks to provide a marked area for pedestrians to safely crossroads. According to state law, pedestrians have the right-of-way in crosswalks, and drivers must stop and yield to pedestrians when they are crossing the road while in a crosswalk. Unfortunately, one woman died as a result of the injuries she suffered when she was struck by a car as she was trying to cross the street.

Accident details

The accident happened around 7:42 a.m. on Dec. 2. A 41-year-old woman from Fremont was attempting to cross the intersection of Blacow Road and Royal Palm Drive. She waited for the crosswalk signal to change on Blacow Road and entered the crosswalk. As she did, a car driven by a 43-year-old woman struck her, and the victim was transported to a trauma center, where she later passed away.

The driver of the car remained on the scene and cooperated with authorities. There were no signs of impairment on the part of the driver, and the accident is still under investigation. Incidentally, this was the seventh fatal traffic accident in Fremont this year.

Seeking financial relief

The surviving family of the deceased woman has the right to pursue wrongful death claims against the at-fault driver.  Regardless of any lack of impairment or reckless driving, the driver obviously failed to yield the right-of-way to the pedestrian. The deceased victim’s family may use that as they build their claim, and they will want to work closely with an experienced personal injury attorney in California.
