How an attorney can help

California police’s investigation may reveal that the sport utility vehicle driver caused the accident due to negligent driving, such as speeding or texting behind the wheel. In this situation, the surviving family members of the car driver who died in the accident have the right to file a wrongful death claim against the sport utility vehicle driver, seeking the reimbursement of financial damages sustained in the accident. Liability must be established, based on a showing of negligence, before the judge that hears the case in civil court. If the plaintiffs are successful in their claim, they may be awarded monetary damages to cover their deceased loved one’s funeral costs and the loss of support for his or her surviving loved ones.
